Claim compromised but in meantime Jas. had conveyed slaves via mortgage to Fletcher. Dispute arose over that conveyance. May be same as/related to 14-pg case found in ET Box 20: James I. Norvell v. Plaintiff purchased a slaves from Charles Luellen for $500 (slaves only identified as "Jane & her 2 children") in order to settle Luellen's debt to him of $500. Plaintiff had bill of sale registered but before he took possession of slaves, defendants took possession of them in order to settle Luellen's debt to them. Plaintiff & defendants were all from Anderson County but case was heard in Knoxville. |

To secure debt, Smith gave Miller mortgage on negro girl, Emily, 9-10 yrs old, "born in his house" & "whom he was unwilling to part with on scarcely any terms." Smith bought 2 notes on Miller, which he planned to use to pay debt to Miller, & told him so. Miller assigned mortgage to Kincaid, a "violent personal enemy" of Smith. Smith's attempts to settle the matter failed & Kincaid (who refused to take pymt other than in silver & gold) assigned the mortgage to Heatherly. Suit to enjoin public sale of girl. |
