Jury convicted Brady, negro/mulatto man (also called Portuguese or French), & Scott, white woman, with misdemeanor of unlawfully living together as man & wife. Ten years prior, they left Green County & came back a month later, saying they had married in South Carolina, & continued to live as such upon moving to Claiborne County a year ago & until this suit brought. Brady's mom & siblings were white. Def. asked judge (but he refused) to instruct jury Brady could not be convicted if his mom were white. |
