Nail tried to argue overflowing of McMillan's land caused not by Nail but by mill race conveying water to mill. |

Nance (who was 60-70 yrs old) attempted to defend himself with fire tongs. Venue changed to Sevier County & then to Cocke County. |

Bogle, dec., had recovered against Tipton on 7 Aug. 1848. Debt was for $17.03 plus cost of suit. |

Fight erupted between Hacker & Ford when Ford was at Hacker's house for dinner, & was preceded by controversy between Hacker & stepfather Brown earlier in the day at barn. Lots of testimony. Then-attorney general James B. Cooke retained to defend Hacker before being appointed AG, so temporary AG appointed. Jurors couldn't agree on verdict, so mistrial; in 2nd trial, Hacker found not guilty of 1st or 2nd degree murder, guilty of manslaughter. |
