Susong claimed Allen instructed his black man to throw down Susong's fence (which he did) & Allen went through his field with a wagon, causing damage. Susong had extended a corner of his fence over an old public road that people used in bad weather (when main road was muddy). Witnesses: pla.'s son William A. Susong, Def's nephew Samuel Allen. Charles and Elizabeth, his mother, were exe. Of will of John Greene, dec. In previous case, judgment had been rendered in favor of Jobe and against plaintiffs for $411.46. Plaintiffs had paid $321.74 and paid balance sometime later. Jobe issued for whole execution at first, then remembered later that $321.74 was paid, but still wanting the rest of the judgment. Plaintiffs seek stay of execution, charging that they had paid balance. |

Wood was a constable in Cocke County. During a suit involving W. H. Fine, Fine & Wood gthered at Robert Mantooth's house. They argued about whether or not Wood was entitled to commissions as a constable. Fine said no, Wood said yes. Finally Wood told Fine to hand over the money to him, which was outside his obligations as constable, & ethically questionable. |
