Dispute relates to judgment rendered in favor of pla. against Defs & executed by levying on negro named George, property of Def. John Rhea. Court refers to Act of Assembly, passed in January of 1861, providing for the stay of collection of debts, and in doing so, states its opinion that at least a portion of that Act is unconstitutional under both the TN & US Constitutions.

Pla., merchants & partners dba Dawson & Skinner in Augusta, GA, recovered $481.88 judgment against Defs J.P. & Bell. Pla. sued to satisfy judgment from J.P.'s equitable ownership of house & lot in Ducktown, TN (No. 4), which Bell sold to J.P. but for which Pickle never registered deed (allegedly to avoid creditors). Similarly, Pltfs say J.P. owns wagon & oxen but colluded with brother John & dad Solomon to say he doesn't, to avoid creditors. Witnesses: Wm Carter, D.B. Bell, Lafayette McLeod, others.

View Entry 1861 The President, Directors & Company of the Bank of Virginia v. Charles Pace & James R. Pace et al Hawkins Debt, Execution on

pla. recovered $2695.45 judgment against James R. Pace, but only property to satisfy it was household furniture, leaving large balance. Before judgment, James transferred goods he owned in Rogersville (from his mercantile business) to brother Charles, which court found to be transaction to avoid creditors. Charles replevied the goods, giving $800 bond, then sold goods at auction. Suit now brought to recover on the bond. Add. def: A.A. Kyle (security on bond), Joseph R. Walker.

Add. Defs: H.S. Mehaffy, Richard Harris, Stokely Brooks, J.W. Parmenter, Joseph S. King. Timmons owed Kyle money & had allegedly absconded to Missouri but, before he left, sold a house & lot in Rogersville to Mehaffy, which sale Kyle believes to be fraudulent & intended to avoid creditors. Kyle also believes Timmons has notes & accounts in the hands of Brooks & that Timmons assigned one note to Def Parmenter, who assigned it to Def King, & that the original assignment to Parmenter was fraudulent.
