Sale of 4 town lots in Sparta in 1860 and where the lot lines were noted was wrong. Complainant wanted to set aside the sale. The defendant denies any fraud and had held the land for 20 years. The land was on the public square in Sparta, but some of the land was adjacent to a public walkway which had been used by the public for years.

This is an appeal. Original suit saw Foster seeking $25,000 dmgs against W.M. Cox, I.L. Cox, H.J. Cox, J. Smith, F. Smith, F. Lenoir, W. Johnson & H. Burem for stealing: 15 boxes tobacco, 20 hogs, 3,000 lbs. pork, 3 tons hay, 2500 bundles fodder, 250 bushels corn, 300 lbs. iron, 1 beef, 7 sacks salt, 24 barrels flour, 500 sacks wheat, 2 horses, 2 mules, clothing & $40. pla. detained & shot in attack.
