Thornburgh executed $100 note in favor of Harris, who gave Confederate money (rebel money) for the note, which Thornburgh used to pay another debt & to pay a high price for medicine. Dispute over whether Confederate money qualified as consideration. Thornburgh argued no consideration for note, since Confederate money not recognized by law as money at all & had no legal value. |

Add. Defs: James C. Bradford, N.B. Swann. James owed Taylor $1100, executed note for same (with Theo as security), & paid $200 on it. Taylor got judgment against James & Theo for nearly $1,000. Then James volunteered in service of Confederate States. When execution issued, sheriff refused to levy on James' effects as he was volunteer in service, so began proceeding against Theo though he was only security. |
