The documents contain the testimony of Samuel A. Bell who commanded the squad that arrested Kimbrough. Bell notes he was operating under the orders of Col. E. D. Blake. |

Snoddy et al. suing attachment suit on land to pay for defendants' debts. They wanted title to land sold and proceeds used as payment for debts as well as an injunction to keep them from selling or transferring the title. |

Additional defendants: Elijah H. Miller and Jenny, a colored woman and former slave. When George Squibb died, he wrote in his will that Jenny would be freed so long as she served his widow through her natural life and that $500 would be issued to Jenny to meet any expense on her way to free country. However, Jenny ran away in 1863 claiming she was a free woman. Because Jenny was a free person with rights of any other citizen, Lynch charged there was no expense to meet and the $500 not necessary. |

Plaintiff originally sued the defendant to recover the value of a horse and now sued for trespass. In the fall of 1863 the horse was left with plaintiff's agent, Eckel, for safe keeping. Shortly after, persons dressed as Federal soldiers took the horse away, alleging that it had been used by the plaintiff in Rebel service. Horse later found in the possesion of the defendant who refused to return it, saying that the soldiers had left it with him & that Rebels could not own property. |

Peck indebted to Gen. Brazelton (who had market in New Market after which town was named; the 2 had history of financial dealings). Secured debt w/deed on 1,000 acres, w/Dick as trustee. On advice of Peck's 2 sons W.R. & Isham T. (visiting from Louisiana), & in effort to settle up, Peck deeded 200+ acres of this land to Brazelton; Peck says intended as mtg. Brazelton took possession of this 200+ acres, leading Peck to file this suit. NOTE: Peck, TN Supreme Court judge from 1822-34, died in 1869. |

Additional defendants: James Gully, John Courtney, William H. Cockreham, and P.M. Kirkpatrick. Dyer sued defendants for trespass to his damage $20,000. Dyer charged that defendants unlawfully arrested and imprisoned him for 7 weeks in 1863. Court ruled in plaintiff's favor for $2000 damages. Defendants appealed. |

Additional documents located in ET 18a. Additional plaintiff: William Johnson. Additional defendants: Benjamin L. Marshal and William R. King. During the contested sale of land, William Johnson, who had equity in the land, was a prisoner of war on Johnson's Island. Case file contains various tax receipts as well as a George Washington 2c stamp and an 1871 newspaper clipping advertising the court ordered sale of land. |

Branner and Mitchell had borrowed from Evans $2100 in bank notes. Branner and Mitchell executed the note and divided the money in half. Branner could not use his notes and Mitchell converted his to Confederate notes. Branner was prepared to pay Evans who refused to take the money for fear he would be robbed. Branner held the notes for Evans until he was killed during war. Galbarith had obtained judgment of $2474.55 against Branner from which he wanted relief. |

During the Civil War Witt owned a mill near Bull's Gap that was often robbed. He asked for Confederate Col. Giltner to send a scout team to protect him from marauding bushwhackers. Giltner did so, arresting the bushwhackers, but also Haun & his brother because they were hiding at the mill. Cause: Trespass, assault & battery, false imprisonment. |

The defendant was accused of unlawfully selling liquor by the quart for a valuable consideration to one Frank Branner, a person of color. The action had the intent that Branner would drink on his plantation where sold without having obtained a license. |

Tipton had bought tract of land from Hurst in 1859 using notes, including $875 in bank notes which were executed in the Bank of Tennessee. Note was assigned to Walker in 1861. During war, defendants were Confederates and Walker a Unionist. Walker was forced to accept Confederate money as payment for the note. Walker now suing defendants to enforce a lien on the land for the unpaid purchase money, charging that the Confederate money was fraudulent and not a payment at all. |

Jarnagin entered into partnership with Sawyers, his brother-in-law, in farming business. Jarnagin sold tract of land to Sawyers, relying on vendor's lien as security for Sawyers' notes. Sawyer fled the country, leaving Jarnagin with his large debts. Jarnagin seeking attachment suit for Sawyers' land, livestock, corn, and a 19 year old slave named Jim in order to sell them to satisfy his debts. |

Rhea sued Flowers to recover a 9-10 year old yellow horse, which was taken by Confederate troops during the Civil War. Court ruled in plaintiff's favor for ownership of the horse. |
