Additional defendants: Elijah H. Miller and Jenny, a colored woman and former slave. When George Squibb died, he wrote in his will that Jenny would be freed so long as she served his widow through her natural life and that $500 would be issued to Jenny to meet any expense on her way to free country. However, Jenny ran away in 1863 claiming she was a free woman. Because Jenny was a free person with rights of any other citizen, Lynch charged there was no expense to meet and the $500 not necessary. |

The testimony of a David Philips was ruled "in error". Philips had testified that the "old man" was jealous of his wife & Smythe, & had told witnesses that she was having an affair with a John Sharpe. Benjamin Dyson executed his will 10. Dec. 1864 and died a few days later. His widow & Smythe are devisees under the will. Moses Dyson claims that Benjamin Dyson was instance, old, and under the influence of his wife, Thomas Smythe and James Donnelly during the writing of his will. |
