Additional plaintiffs: J.B. Raulston an Joseph G. Laukaster. Additional defendants: Milly Rogers and Larkin Willis. B.B. Raulston had obtained judgment against J.B. Rogers for $250 but by agreement execution was stayed 8 months. Amount remained unpaid. Laukaster and Raulston were admr. Of J.B. Raulston and had obtained judgment against Rogers for $500; his notes were still unpaid. Plaintiffs suing for defendants' lands to be attached to satisfy judgment and notes.

View Entry 1872 James M. Carroll et al.v. Erasmus Alley et al. Marion Fraudulent Conveyance

The plaintiffs were heirs to Thompson Gardenhine, dec. Plaintiffs charge that the decree for the sale in the Supreme Court is void and that there was no fraud between Gardenhine and Carroll. They charge that Gardenhine paid for the land and according to the trust, the plaintiffs are entitled to the land. Plaintiffs seek injunction against clerk and defendants from selling the land.

View Entry 1872 John G. Kelly, et al. v. Washington Pryor, et al. Marion Promissory Note

Additional plaintiffs: A.A. Hyde, William Owen, and B. Lasater. Additional defendants: E.F. Redfield & William Bryan. Kelly, et al. as plaintiffs sued defendants who had jointly with them signed a promissory note for $2752 payable to James Levan. Levan had sued Kelly et al. and E.F. Redfield & Co. for note. Redfield & Co. now insolvent and borrowed money from Pryor. Plaintiffs want an account taken of their transactions-to know amount borrowed and what merchandise given to Pryor.

View Entry 1872 James C. Haselton & William O. Giles v. Varney A. & Harriet L. Gaskill, et al. Marion Land and Title Dispute

Additional defendants: John Badge, Eugene Eaton, A.L. Eaton, and Erasmus Alley. Plaintiffs Haselton and Giles had commenced action of ejectment against defendants in Marion county Circuit Court to recover lands which are subject to the right of way for the use of the Nashville & Chattanooga R.R. Co. Plaintiffs charge they were dispossessed of these lands by defendants who unlawfully detain them. Plaintiffs want all clouds to their title to said land be removed.

Opinion only. Wood et al., the heirs of R.B. West, sued Ethedge to recover a tract of 1000 acres situated in Marion County.

View Entry 1872 Marsh & Allgood v. P.L. Rankin & William M. Bennett et al Marion Debt

Add. defendant: William R. Rankin. Defendants are partners in a firm under the name Rankin & Bennett. Defendants are justly indebted to the plaintiffs in the sum of $1,010 plus damages in the sum of $2,000 for withholding the funds.

View Entry 1872 Nashville & Chattanooga Railroad Company v. C.C. Smith, admr. Of John Smith, dec. Marion Trespass and Damages

C.C. Smith sued railroad company to recover damages for death of John Smith who was killed on the tracks. Court ruled in favor of C.C. Smith for the use of Nancy Smith, widow, and the minor heirs of John Smith, dec. for $6000 damages. Defendant appealed.

Cowan sued defendants to recover a tract of 125 acres from the defendants who unlawfully withheld from him to his damage $500.
