These two cases were consolidated. This case concerns the sale of land of the estate of Joshua Miller of which R. H. Young, the debter of Wolford & James & Jones was the owner. Both parties claim fraud by writ of attachment. Thomas Miller, exe. of Joshua Miller procured the sale of a tract of land of the estate of his testor, under decree of Chancery Court at the sale Young was the purchaser at $1000. |

In 1857 Looney sold Samuel Gower or Grover land in Franklin County. Gower executed a promissory note on the sale, however Gower died soon after. Holder was appointed admr. of the estate and the land was resold by order of the estate. However, the debt to Looney as still not paid. He sued to recover the debt. |
