Plaintiff was a confederate soldier in the Civil War, at which time he was ordered to get a horse from a certain home. After the war, plaintiff was charged with being a horse thief and required to submit a note for the repayment of the horse. Plaintiff later discovered defendant to be in possession of stolen horse and demanded that horse be returned to him, so that he could return it to the owner. Plaintiff also requested the note be deemed and void since he found the horse and planned to return it
