Rush, a brakeman on a train that had mechanical problems, was sent back up the track to warn 2 oncoming trains that the track was blocked. He warned the 1st train, but when the 2nd passed, he was out of flares, & sat down on the track with his lantern to warn the oncoming 2nd train. It was foggy night. He was sleepy & dosed off on the tracks until the cow catcher of the oncoming train hit him in the head. Rush sued for damages of $1000. |

Gardenshire, & grandpa of Caldonie (Susan's dau), died in Chattanooga in 1840, owning slaves & land (subject of dispute). Caldonie says Wm left will in which he freed slaves & left property to Susan for life, remainder to her children, but after Wm died, George & others concealed will from Susan & her children. Many yrs later, Susan & Caldonie became aware of will & filed suit. See related case: ET Box 79 (circuit ct). |

Powel sued the rail road for the loss of a box containing goods headed for Union Springs, Alabama. Powel was moving his family from Tennessee to Alabama and shipped his household goods in multiple boxes. One box never arrived. Apparently the boxes had to change cars during the trip and the railroad alleged that the charges for changing cars was not paid. |
