Case file incomplete; brief only. In May, 1883 Acuff contracted with Cox to sell him a tract of land in Raccoon Valley containing about 130 acres. Price for the land was $800.00. Cox paid about $450.00. and executed a note for the remainder. At the time See ET Box 1871 as well - no deed or title was drawn as some surveying needed to be done. Cox became very ill and Acuff was advised to draw up a deed but kept the deed in his possession. Cox recovered and refused to acknowledge deed as was written. |

However the defendants attempted to recover certain costs and the plaintiff filed this injunction to prevent the recovery of said money. The chancellor awarded the plaintiff $1196.40 and court costs, issuing the injunction against the bill in the circuit court against the plaintiffs. |

The defendants failed to deliver the livestock and under the contract were supposed to pay $1 per head in damages plus a deposit put into a local bank. The defendants refused to pay either sum. |
