Additional Defendants: Wilthorte Bros. Original bill filed against Duncan F. Jett, Thomas S. Steele and wife Nanny Steele, E. L. Jett, James C. Jett, Mildred Jett, Carrie Jett, and Sallie Jett, heirs of William S. Jett, deceased. William Jett conveyed a tract of land to Bivens for several notes. However, he did not hold clear title. Jett died after passing the notes to others who filed suit for recovery of payment. Bivens filed to have the sale by Jett rescinded and the notes cancelled. See box MT 1123. |

The plaintiff claimed they completed most of the work but were prevented from finishing it by an injunction. The defendant took possession, completed it, and claimed that the plaintiff failed to do the contracted work. Plaintiff sought accounting of the work he completed and repayment of such. |
