View Entry 1883 Coraw Acuff v. C. S. Cox, et al. and Halston Salt and Master Co. v. C. S. Cox et als. Union Land and Title Dispute

Case file incomplete; brief only. In May, 1883 Acuff contracted with Cox to sell him a tract of land in Raccoon Valley containing about 130 acres. Price for the land was $800.00. Cox paid about $450.00. and executed a note for the remainder. At the time See ET Box 1871 as well - no deed or title was drawn as some surveying needed to be done. Cox became very ill and Acuff was advised to draw up a deed but kept the deed in his possession. Cox recovered and refused to acknowledge deed as was written.

Add. Defendants: Aida B. Marbury, Delila Marbury, & F.M. Marbury. J. Marbury is the widow of M.P. Marbury (dec.). M.P. Marbury sold Freeman a large tract of land before his death, but never executed a deed of rightful possession to him and after his death, his widow and children took the land back to sell for a dower and living means. Freeman filed the bill to obtain rights to the land. Includes assignment of error.

Add def.- J. R. & Nancy J. Allen, Susan, Jacob A., & W. L. Smith. Ezekial Smith sold his son Andrew T. a tract of land. A. T. Smith owed money to Andrew Cable & in order to avoid this debt, A. T. Smith transferred the land to E. Smith with the stipulation that it would later go to his wife Susan. A. T. Smith died intestate, the land went up for auction & the Wagners purchased it. This is a suit to recover the land. Allegations of nepotism from Judge R. R. Butter & Chancellor Smith. 215 pages in ET1936

View Entry 1883 Martha Dickerson [Dickenson?] [Dickinson?], by next friend William H. Brown v. Frank Parker et al. Wayne Land and Title Dispute

Additional Defendants: David I. Dickerson, I.H. Davis. Plaintiff's husband, D.J. Dickerson, entered into contract with Def. Parker pursuant to which the two traded land. Plaintiff (who says she was illiterate) has possessed the land at issue since then. At some point, there was an issue re: the need to sign new deeds, as the wives had not signed the originals. Plaintiff signed the deed, but Def. Parker never made good on his promise to get his wife to sign a new deed. Martha was 87 at time of suit.

Brown claimed title to a tract of land in the 8th civil district of Claiborne County on the north side of Powell's Mountain, which he alleged he purchased from Prior Garland. Bussell claimed land through a levy and placed James Rice in possession. Related to Charles Bussell v. S. C. Brown et al. in ET1228 that sought to eject the plaintiff and claim rights to rent money.
