Add. Defs: R. N. Magill, W. M. Magill, and L. A. Magill. In 1878, J. H. Magill executed three "renewal" notes to Lana Cate for $1,339 of which the plaintiffs sought repayment. The debt had been to her husband Greenberry Cate, dec. and included in his will The Cates alleged that J. H. Magill had certain property subject to sale for repayment and that the codefendant sons claim to ownership was a fraudulent conveyance meant to prevent their rightful recovery of debt. W. L. Doss owned a tract of land and conveyed land to Swaffer. Jane, Doss’s wife, would not sign the contract and it was never registered in the Register’s office. Doss moved the family to a poorer farm against Jane's wishes and she later filed suit to recover the land from Swaffer. Next friend Thomas L. Dixon. 90 pages in ET1940 |
