Case file incomplete; brief only. In May, 1883 Acuff contracted with Cox to sell him a tract of land in Raccoon Valley containing about 130 acres. Price for the land was $800.00. Cox paid about $450.00. and executed a note for the remainder. At the time See ET Box 1871 as well - no deed or title was drawn as some surveying needed to be done. Cox became very ill and Acuff was advised to draw up a deed but kept the deed in his possession. Cox recovered and refused to acknowledge deed as was written. |

The plaintiff claimed they were mislead regarding the cost of work with the defendant and renegotiated their contract. However the defendants attempted to recover certain costs and the plaintiff filed this injunction to prevent the recovery of said money. The chancellor awarded the plaintiff $1196.40 and court costs, issuing the injunction against the bill in the circuit court against the plaintiffs. |

The debt had been to her husband Greenberry Cate, dec. and included in his will The Cates alleged that J. H. Magill had certain property subject to sale for repayment and that the codefendant sons claim to ownership was a fraudulent conveyance meant to prevent their rightful recovery of debt. Plaintiff had invented a type of press and contracted with the Taylors to construct it so it could be displayed at the Rhea County Fair. He says the press they constructed was of inferior quality, as was a second attempt. Additonal pages found in box ET 1690 and in 2 folders. |
