Addional defendant: Elizabeth Bradley, admr. of J. L. Bradey, dec. Miller wanted to exchange tracts of land with complainants, who originally refused. Foster did agree to exchange land with Carraway, a neighbor. Carraway allegedly colluded with Miller to get the deed for Foster's land to give to Miller, and had no intention of exchanging land with Foster. Miller denied the allegations. Foster had purchased said land from J. L. Bradley.

View Entry 1883 J. R. Bates v. J. H. Cooper et al Perry Fraudulent Conveyance

Add. Defendants: Soloman Cooper, E.W. Easley, G.B. Price, James Warmack, and Nathan Grinsby and wife, Sarah. Bates purchased tract of land from Cooper and siblings that was willed to them by their father. Cooper & Price conveyed they could make a good deed for the land, but later filed a bill stating the deed excluded a title to Bates, making it invalid. The bill did not include Bates as holding interest in the land even though he executed payment notes to Cooper and Price.

View Entry 1883 James M. Freeman v. Jerusha Marbury et al Coffee Land and Title Dispute

Add. Defendants: Aida B. Marbury, Delila Marbury, & F.M. Marbury. J. Marbury is the widow of M.P. Marbury (dec.). M.P. Marbury sold Freeman a large tract of land before his death, but never executed a deed of rightful possession to him and after his death, his widow and children took the land back to sell for a dower and living means. Freeman filed the bill to obtain rights to the land. Includes assignment of error.

View Entry 1883 James M. Ferguson v. M.C. Goodlett Montgomery Error in Proceedings

In the original suit, Ferguson bought land from his grandfather's estate. When his grandfather died he claimed that land. Goodlett also claimed the land because Ferguson had not paid his debt to him. Complainant claims that the judgment made in error because the defendant as executor made a settlement with the County Court without notice of any party in interest and are not binding on them. 2 folders

Add. Defs: R. N. Magill, W. M. Magill, and L. A. Magill. In 1878, J. H. Magill executed three "renewal" notes to Lana Cate for $1,339 of which the plaintiffs sought repayment. The debt had been to her husband Greenberry Cate, dec. and included in his will The Cates alleged that J. H. Magill had certain property subject to sale for repayment and that the codefendant sons claim to ownership was a fraudulent conveyance meant to prevent their rightful recovery of debt. W. L. Doss owned a tract of land and conveyed land to Swaffer. Jane, Doss’s wife, would not sign the contract and it was never registered in the Register’s office. Doss moved the family to a poorer farm against Jane's wishes and she later filed suit to recover the land from Swaffer. Next friend Thomas L. Dixon. 90 pages in ET1940

File contains three briefs from this case first tried in Monroe County, East Tennessee. Other defendant is Zachary Taylor, part owner of Taylor Bros., a foundry. Plaintiff had invented a type of press and contracted with the Taylors to construct it so it could be displayed at the Rhea County Fair. He says the press they constructed was of inferior quality, as was a second attempt. Additonal pages found in box ET 1690 and in 2 folders.

Add def.- J. R. & Nancy J. Allen, Susan, Jacob A., & W. L. Smith. Ezekial Smith sold his son Andrew T. a tract of land. A. T. Smith owed money to Andrew Cable & in order to avoid this debt, A. T. Smith transferred the land to E. Smith with the stipulation that it would later go to his wife Susan. A. T. Smith died intestate, the land went up for auction & the Wagners purchased it. This is a suit to recover the land. Allegations of nepotism from Judge R. R. Butter & Chancellor Smith. 215 pages in ET1936
