Asa and Eliza Teal had owned a tract of land for 7 years when Walker came one day claiming he bought the land and had a deed to it. Walker pressured Teal to sign a paper making him a tenant on the threat of being thrown out of his house. In pending case, Walker sued for unlawful detainer and to collect rents. Teal suing for injunction against Walker's suit and clear title to said land. This files contains many misc. deeds, notes, conveyances, etc. dating back to at least 1827. 2 folders.

Add. plaintiff: J. A. Woodland. The defendant was the owner of a steam saw-mill worth $2,000 and certain timber worth $720 on the land of C. H. Bean. Defendant was negotiating a sale of the mill and timber to Haslett & Co, but later sold it to the plain- tiffs under their firm. The defendant failed to inform them during negotiation that per an original contract, one T. Ashby held a lien on the mill and the defendant actually had no legal title to it, despite the plaintiffs paying a $720 note to Haslett.

Property dispute with Annabella M. Beckett; complainant claims ½ interest in properties, along with Louis Beckett, Peter Beckett. Other plaintiffs include Louis Dauriac, Jean-Baptist Dauriac, Lady Maria Dauriac, etc. and other heirs of Clement Dauriac, dec. Properties near Pigeon Roost Road in Shelby County. Appealed to TN Supreme Court.

Property dispute re: Lot #2, Perrin & Wickersham subdivision, City of Memphis, Metcalf 4 acre lot. Construction of railroad track, Memphis & Ohio R.R., across said lot in 1856. Lot sold by decree by Wickersham's admr., in 1881. Heirs of Wickersham dispute property sale, alleging that taxes were due on said properties.

On final settlement of James Hughes' estate, the defendants had received $2435 more than their true share of the estate. They had purchased a tract of land from the Court on a credit of $3480, more than they were entitled to. Court required defendants to give a bond to refund the excess. Hughes suing to enforce that decree and compel the defendants to refund that balance or have it enforced against the trust property. 2 folders.

Much of this document has been rendered illegible by mold -- it is extremely fragile. File contains a couple of legal briefs. This case involves a debt involving a commission for the sale of machinery.

Add dfnts were Nancy McKamy, Samuel McKamy, Jordon Lively, Jr. The pltf claimed they were the "owner in fee" of a 5,000 acre tract of land conveyed to them by Churchwell Richardson. Pltfs. Allege that John C. McKamy had wrongfully lived on a portion of this property and that his heirs had no right to the land. Exhibits include assets statement.

Pltf firm composed of James D. Cowan, Perez Dinkinson, C. J. McClung, F. H. McClung. Dfnt firm composed of H. L. King and P. C. King. Suit was filed to recover debts on various notes from property. Pltfs allege dfnts "fraudulently disposed of their property."

Additional Defendants: Caesar Weatherford, agent & back tax collector for the state & Walter Merriman. Durivage, age 9, sued by his guardian, Johanna Welsh, charges that he is being ordered to pay back taxes that he does not owe. Plaintiff inherited property from father, Charles Durivage, Sr., dec. yellow fever 1878. Father inherited property from his mother, Mrs. Cornelia Cook, who also died of yellow fever 1878. Plaintiff's mother died 1883.

Butler sold land to Mary Jane Partin, her husband Ludwick Partin surety. Children: Daniel J., Mary E. (wife of W. L. Bryant), William A. Partin & Ludwick Partin, Jr.

Additional defendants: J. C. Davis, A. R. Davis, R. J. Black.

M. M. and J.H. Patterson, minors, sued by their guardian Pinkerton. Too many additional defendants to name. When R.C. Patterson died in 1865, he left a tract of land to plaintiffs' father Carson W. Patterson, who died in 1870. Plaintiffs charge defendant with fraudulently obtaining a deed from R.C. Patterson for the same land by undue influence and destroying his will. Plaintiffs suing for title to land. Part of case found in box MT 783 under D.T. Pinkerton et al. v. J.W. Blackburn et al. 2 folders.

Plaintiffs: D. R. Samuel and W. B. Samuel. Defendants: F. A. Crittenden and A. J. Scott. Plaintiffs claim they leased their saw mill to the defendants for 5 months at .50 per 1,000 ft. of lumber sawed up to $400 per month. A "lack of water" clause… stipulated an agreement if the river was too low to float logs. Plaintiffs also claim damages for loss of logging stock and equipment. Defendants denied the claims.

Margaret Cooper is the wife of I. C. Cooper dec. This case involves a note given by the plaintiff to Cooper before his death promising to pay to the plaintiff $200 in gold. Plaintiff is seeking payment by the estate. Case file notes that Plaintiff's parents died when he was a child and at one time he lived with his uncle Turner Qualls. Case file notes that at the time of the trial, Dillard Qualls is 28 or 29.

Carlock defaulted on land, but began paying it back, redeeming his claim to the title. However, he alleged that bank took his land wrongly and did not reimburse him for his equity. Additional materials in ET 1906 (Range 19, Section A, Shelf 2).

Additional defendants: F.M. Jones and Grady Jones. Isbell sued defendants for rights to land, which were sold to P.C. Isbell by decree against Edmund Monroe, dec. for debt. However, defendants refused to give up land they were tenant to and threatened to shoot anyone who tried to eject them. Isbell also wanted receiver to take charge of corn crop on land to prevent defendants from using, selling, or destroying the crop.

Plaintiff claimed title of 3,340 acres of land in 16th civil district of Blount County. Defendants include J. C. M. Boyle, S. D. Cochran, H. O. Wilson, J. N. Cates, C. T. Cates, B. A. Morton, J. H. Morton, A. L. Wells, Willie Wells, John Mills, etc. also claimed title of said land.

Additional defendants: Nannie B. Noel and W.H. Washington. Defendants had conveyed tracts of land containing about 76 acres to Washington for $11385 to be paid in two notes and lien retained until payment. Washington sold lands to E.T. Noel who promised in deed to pay the other note made by Washington for $5692.55 for L.G. Noel. E.T. Noel charged L.G. Noel for not reinvesting said sum in real estate for Nannie B. Noel as required by terms and conditions and his title be decreed good.

Just after end of Civil War, John England died w/will, naming sons Elijah & D. S. executors. Original will equally divided considerable estate among 8 children, but later-executed codicil disinherited daughter Fanny Scott. That case settled (SEE Francis Scott by next friend E. Jarvis v. D. S. England & Elijah England (MT 608). This suit filed 15 years later over claim of Elijah (illiterate) that D. S. (now dec) handled all estate money & that he mismanaged certain estate funds; Elijah wants accounting.
