Foster was accused of attempting to kill William T. Wattenbarger. He hid in the bushes in broad daylight while Wattenbarger approached on the road. The defense argued that the jury was coerced in its decision. The main evidence was a pair of shoes worn by Foster the day of the shooting, and the tracks they made in the freshly plowed soil of the corn field. |

Isaac Cookston was too poor to care for his son, so the 9-year-old boy was sent to live with the Fosters, who would treat him as their child. He testified that he worked as a lackey boy doing farm and house work. "They furnished me with [John W. F. Foster's] old cast off clothing….I had to eat at the second table, and if there was any negroes there I had to eat at the same table with them." He slept in the potato house for years. The Fosters taught him at home. Cookston sued for $3,000 lost wages. |
