W. M. Willhoite sold a house to Morris. He also transferred his insurance policy from the defendant company to Morris. The house burned down, and the defendant co. claimed that Morris did not submit the paperwork on time to receive benefits. The plaintiffs here sued.

Def. in error was the owner of a mercantile business selling dry goods, groceries, hardware, and produce, located in Charity, TN. The building which housed said business and the stock of goods inside were destroyed by fire on April 15, 1890. Def. claims said business was insured against fire by the pla. in error and complains that pla. has refused to honor the insurance contract. Def. is seeking payment. Reese also spelled, "Rees."
