Plaintiff in error was a prison guard responsible for guarding prisoners leased by the State to work in the Coal Creek watershed. Plaintiff was observed carrying a pocket pistol while off duty and the State brought charges. The event occurred two days after General Samuel T. Carnes' forces were deployed to Coal Creek to suppress a labor uprising known as the Coal Creek War. Murfree argued that because of the uprising and potential for conflict, he was always on duty. |
