Neal wishes to cancel a mortgage on the grounds that it was overpaid when he was the borrower from New Orleans Loan, Building, and Savings Association. When that institution went into liquidation it transferred the mortgage to the defendant. The new loan was under the guise of a new loan. All payments to the original loan should be credited to this loan which has been dealt with. |
