Plaintiff sued railroad for damages in the amount of $1999, charging that the negligence & recklessness of its employees caused him to be injured while a passenger on a freight train operated by the company. Train was traveling at a high rate of speed when it was stopped so suddenly that plaintiff was thrown violently from his seat, causing fractures, dislocations, bowel abscesses, appendicitis, etc. |

A doctor had recommended spirits for the sick man. McCann entered the saloon a second time to obtain ice, again without permission & contrary to town ordinances. He stated he'd enter his saloon on a Sunday whenever he wished. |

It was alleged that defendant beat her and then threw her off of the bridge or trestle breaking her neck. Defendant found guilty of voluntary manslaughter.
