Opinion only. Brannon sued the defendants, the sureties of his former guardian, upon a bond executed by said guardian when plaintiff was a minor. The guardian had died and his estate was insolvent. Chancellor gave judgment against the sureties for the balance due the plaintiff. Question of whether Brannon should have brought suit in the name of the State and not in his own name. File contains same case twice. |
