D.M. Cooper was elected to the Financial Board of Hickman County Bank in 1905 - his title being that of Cashier. Sometime around June 1905, the John M. Smith Lumber Company of Dickson opened an account at the Hickman County Bank. The Hickman County Bank began discounting large amounts of its notes and to take credit which resulted in a small balance in favor of the bank. D.M. Plaintiff, which is based in CA, sued defendant for breach of contract. On 31 July 1908 defendant contracted with plaintiff to buy 500 sacks of large Blackeye Beans which were shipped on 6 Oct. 1908. Without cause defendant refused to accept beans. After the refusal the price of beans declined, forcing plaintiff to sell the shipment to a broker at a $392.83 loss. Defendant argues beans were not accepted because they were full of dirt. |
