While waiting on a siding for a train to pass, plaintiff was hit by a train backing onto the siding and injured so badly he had to have his feet amputated. He claims there was no one on the back of the train to watch for people or obstacles, and no warning whistle, and that the noise of the passing train blocked the sound of the train on the siding. |
