Recovery of previous trial judgment. Mrs. Martin claimed that she gave Miles $2500 to be loaned and/or invested for her, at interst in a note secured by trust or mortgage on lands near Union City. "Defendant represented to complainant that his father held a note well secured by Trust Deed or mortgage on land." Miles said he would buy the note and assign it to Mrs.Martin if she would let him have the money to buy it. He also promised the rate of interest would be "a good and paying investment for her."

In this instance, four similar cases were tried together. Defendants in error sued the city for laying a cement sidewalk in front of their property and above the natural grade of the street. Pla. claims that the homestead rights of Cadle and wife have been terminated by virtue of moving out of State but notes that the Def. still possess the property.
