Ike A. Chase rented his farm to D. C. King. The contract stipulates that he rents as shares part of his place known as Burch Place for the year 1917. King agrees to care for the place himself and cultivate all tillable land that is practicable. He also agrees to cut no timber or dispose of any. In January of 1918 Chase wanted to reclaim possession of the farm but King would not leave. |

The defendant breached the contract because they failed to take the water on the west side of the railroad, carry it to State 48, passing through an opening onto the east side of the railroad to a creek bed at the lower corner of a woods lot. The defendant breached a contract with the plaintiff drawn in October 1916 for the delivery of two car loads of scrap iron to the plaintiff, but which the defendant refused although the plaintiff stated they were still willing to do business with Simon. Suing for damages for the breach in a sum under $500. Judgment went to the plaintiff for $150 plus costs of the suit. |
