A.S. Kerr sued out a civil warrant to collect a debt against L.M. Johnson. J.M. Raines, constable of Madison County, was responsible for executing the warrant and collecting the account. Raines collected a judgment of $24.65 and only paid Kerr $20.00, with Raines keeping $4.65. Raines claimed Kerr promised to pay him outside of his costs also, but Kerr denies this. A driver of a Chattanooga Medicine Co. delivery truck had a head on collision with a motorcyclist. The truck made a right turn at an intersection and the motorcyclist ran into the truck. Brannon sued for $20,000 in damages for the injuries he sustained when hit by the truck. The accident caused two compound fractures on Brannon's left, and once it healed his legs were different lengths. Both Pl and Def accused the other of speeding and driving recklessly.
