A. C. Fry instituted this suit against the Illinois Railroad Company in October, 1926. On Sept. 5, 1925 a section crew of the defendant railroad was burning off the right of way of defendant adjacent to the farm of the plaintiff. The defendant allowed a fire to burn off clover hay in plaintiff's field amounting to $174.00 in damages. Barnes for $2500.00. The complainants charge that W. J. Barnes conveyed the land without the knowledge of A.G. Barnes. Complainants charge he did this in order to pay off creditors. He did pay off his creditors and wanted his son, A. G. Barnes to re-convey the land back to him. |
