Clapp sued West to establish each parties equity in a farm the two had purchased together. West denied partnership or ownership of the farm. The suit then attempted to discover whether the two were partners or tenants in common. The farm had originally belonged to J. C. Rutherford and his wife, but they lost it to the bank, who then sold it to West and Clapp. The Rutherford's then attempted to recover the farm. |
