Additional defendants: Henry Barker and Lucille Barker Morrison. Defendants leased a tract of land to Merman for $50 a month. Merman had paid off every month and asked if rent could be dropped to $35 a month temporarily due to the Depression, which J.M. Barker Jr. agreed to. He later informed Pla. that he rented property to someone else even when Pla. offered to pay the $120 unpaid balance. Pla. sought certiorari against def. for possession of land from their earlier unlawful detainer case. |
