Johnson City sued the defendant for costs of building under provisions of the private acts set forth by the General Assembly. The act states that any improvement to private land by the city is chargeable to the land owner. The defendant does not believe that the road was of any benefit to them and therefore they are not liable to pay any of the said costs. |

Plaintiff sought decree to help them settle and determine Section 3 of Chapter 401 of the Private Acts of TN for 1929 to know its rights to collect taxes on the added territory for 1930 and its rights to refunding taxes already paid. |

He was sued for breach of warranty and sought an injunction restraining the defendant from selling his property or collecting what was due under trust deed. Pla. accuses the def. of failing to pay for two trucks purchased from Pla. Casefile notes that the Tri State Fruit Co. agreed to purchase a new General Motors Model T-21 truck for $1,695 with the stipulation that Shipley pay $700 for 2 older trucks owned by the Fruit Co. Def. claims Pla. violated their contract by refusing to pay for and take possession of the new truck. |

Defendant was the owner of a vacant lot in Johnson City who leased it to the Hart and Houston Store from 1914 to 1927 and then the plaintiff starting in 1928. Plaintiff arguing that since they were paying rent month to month, they have the right to surrender the building at the end of any month. Plaintiff wanted its right, status, and legal relations with the defendant declared and it determined whether it was bound to def. by contract. 2 folders. |

Tannewitz was driving her DeSoto Sedan when the driver of J.G. Sterchi Stores Inc. car made a sudden turn without warning back onto the highway and came to quick stop. Caraway, driving behind, his the Sterchi Store car, swerved to the left and ran into plaintiff's car. Plaintiff was knocked out of front seat, causing injury. Due to the negligence of the defendants, plaintiffs sued for $500 damages. |

Gaunt's insurance business office was located in the Arcade Bldg, which was opposite the place Gaunt was waiting to cross the street. Witness to accident: Burl Arthur (selling Christmas trees on Mr. Parson's lot). Court ruled in favor of King. |

Add. Def: J. Walter Marshall and J. A. Allison partners under the trade name Marshall Construction Co. Pla. was married to James Russell dec., a carpenter who worked for the Def. on the construction of an addition to the high school in Johnson City. During his work, James Russell fell from a height of 5 or feet and sustained traumatic injury. He died 3 months later as a result of the fall. Pla. is seeking to recover Workmen’s Compensation benefits. Casefile notes James Russell made about $5 per day. |

Earley charged and convicted of assault and battery upon Kate Myers, 20 years old, and violently, forcibly and againist her will, ravish and carnally know her. Myers became pregnant and the baby was a month old at time of case. Earley was sentenced to 3-5 years in penitentiary. |

Myrtle Elliott was the wife of Luther Elliott who worked for the defendant and accidently fell while on the job, hitting his head against a cast or iron pipe, and died. Luther's wage of $12 a week. Myrtle sued for Workmen's Compensation. Court ruled in favor of defendant; that Luther Elliott did not die as a result of an injury or accident from hitting a pipe but dropped dead from some natural cause. Therefore, Myrtle was not entitled to compensation. |

McFaddin came to her home to take her to see her sick daughter in Catawba, but son-in-law McCroskey drove instead of Dr. McFaddin. McCroskey tried to pass a car, but lost control, wrecked car in ditch, injuring Mary. Witnesses: Dr. E. T. West, Dr. Lee K. Gibson (Mary's treating doctors), Mrs. Spraker (hospital recordkpr). Jury ruled for Mary, $2,250 damages. |

Def. in error allegedly suffers from an illness called Jake Leg which is contracted after drinking an intoxicant known as Jamaica Ginger. |

Pla. and the dog were involved in a fox hunt on the land of Opie Ferguson when Pla. lost sight of the dog. Several days later, Pla. found his dog buried on the land of the Def. After inspecting the dog's body, Pla. discovered that his throat had been cut. Exhibit material includes a dog pedigree chart. |

H.C. Gray, father of Harold Gray, sued the gas company for $15,000. While plaintiff was driving his motorcycle on Walnut Street in Johnson City in a careful manner, one of the agents of the defendant (Lew Price) drove a Ford automobile in a careless manner by suddenly turning left and suddenly stopping without warning. Def. collided with plaintiff's motorcycle, causing him to be knocked several feet, causing permanent injuries and impairing his capacity to earn a livelihood. |

Hall and her husband Z. E. Hall owned an REO Flying Cloud Coupe subject to conditional sales contract held by the bank. The Halls charged that McCanless was unlawfully detaining the car for a gambling debt. Mr. Hall stated that he was lured into McCanless's professional gambling house and lost all his money and a $200 check McCanless cashed. |
