Plaintiff sued Low, claiming he was trespassing by using wagon road that crossed Plaintiff's land. Low (whose land adjoined Plaintiff's) said road was public road. Land at issue on New River near Rosedale Brick Schoolhouse. Low's land (aka Patterson tract unoccupied for more than 20 yrs but fruit gathered & timber cut & removed from it, and those products carried out on road in question.
