Plaintiff was arrested on the 4th of July while carrying home brewed alcohol from his car into his restaurant. The arresting officer found 72 bottles of what appeared to be home brewed alcohol. The contents of the bottles were never analyzed. Plaintiff's restaurant is described as being in the City of Athens in the Wilson building near the L. & N. Depot. |

Appeal case only. Plaintiff worked for the railroad and was drafted into the US Army and according to the contracts, rules & regulations by defendant all employees entering the services would be allowed to return to their jobs along with full seniority. McClure sued for his seniority ranking to which he was entitled to according to the contract. Exhibits include bylaws, correspondence, rules & regulations, magazine, etc. 6 folders. After initial mistrial, Fleming convicted of unlawfully selling liquor, fined $100, sentenced to 90 days jail. Witnesses: Jimmie Boyer, 17, student at Tennessee Wesleyan College in Athens, bought whiskey from Fleming in basement of Robert E. Lee Hotel, called before college discipline committee, which required him to find out who sold it to him w/in 24 hrs. or risk expulsion; Harold Gastman, 18, also Wesleyan student, assisted in drinking; |
