Incomplete case. Briefs and petitions only. In October 1928, Sweetwater Realty Co. conducted an auction sale for Millsaps. Any property brought under $10 was to be paid with cash in hand and anything bought for over $10 in 12 months time, except the cows. Foster bought a cow for $75. Millsaps tried to collect on note, but Foster said it was not due for 12 months but maturity date was changed to 6 months. Court ruled in Millsaps' favor for $75 and Foster appealed. Pla. Later filed for certiorari. |
