Add. Defendants: Fletcher Brown & Frank Thomas. The parties entered into a written agreement for the timber located on a farm owned by one Robert Chad well's heirs to haul the timber away. This was carried on for some time by the defendant, but S. Brown took over, but failed to take the logs off the property after cutting them, failing to uphold the contract. Later, the defendants under careless management, stacked the logs in a negligent manner, injuring the integrity of the lumber. |

The plaintiff shipped one bird dog from Finger Tennessee to Fort Plain, New York. While the dog was in the possession of the defendant the dog was injured and by reason of such injury became worthless and thus breach its said contract. |

He was sued for breach of warranty and sought an injunction restraining the defendant from selling his property or collecting what was due under trust deed. The defendant had made a mistake on all lots on block whereby the houses erected on said lots overlapped on the property of adjoining lotowners. Exhibit includes a map of the lots on Baxter Street. |

In 1928, the parties entered a contract where the plaintiff agreed to buy lots and build 12 houses on them, ready for occupancy a few months later. The defendant agreed to be liable for the rent for the first ten years, at $393.10 per month. After the first month, the defendant refused to pay the plaintiff, instead collecting rent from the houses but not forwarding the money, even though the plaintiff accepted a loss of $10,000 due to the contractual estimate for construction. |

Original bill was a complaint about the collection of a trust fund by P. V. Hunter in his capacity of agent of the plaintiff, for which it made a bond by depositing with the company $2 per week out of the collected commissions. Hunter also sued insurer for $50,000, alleging that upon retirement the company had tried to libel him with these charges. Exhibit materials are checks and ledgers. The notices were warnings given to the Road hands to perform their work duties on the local roads in Crockett County. Original bill was filed when a breach of contract by N. A. Lackey occurred in 1927. The defendants bound themselves in a contract to furnish the plaintiffs' with $5,000 worth of building material and lumber and to use their best efforts to obtain a loan on their property if they didn't have the funds to pay the defendants when building was complete. The plaintiffs later failed to carry out their terms of the contract by paying 15% of the material not used, or $750. |

Shipley for the rental of their house situated on the corner of 6th and Anderson streets in Bristol, TN. Said contract included guarantees by Shipley that be make repairs and improvements to the property. Shipley sold the contract to J. H. Wolfe. Pla. claim neither Wolfe nor Shipley made improvements and in fact damaged said property. |

Spivey sued Rhea County Board of Education & Superintendent for payment for work he said he completed per contract with Board, under which Spivey agreed to build plumbing & heating system in Rhea County High School. Chancellor ruled in Spivey's favor. Issues seem to involve authority of Board to contract & whether Board could be sued. SC rev'd chancellor's ruling, but said Spivey could sue Rhea County for any balance due on his work & could sue Superintendent & mbrs of Board of Education individually. |
