Spivey sued Rhea County Board of Education & Superintendent for payment for work he said he completed per contract with Board, under which Spivey agreed to build plumbing & heating system in Rhea County High School. Chancellor ruled in Spivey's favor. Issues seem to involve authority of Board to contract & whether Board could be sued. SC rev'd chancellor's ruling, but said Spivey could sue Rhea County for any balance due on his work & could sue Superintendent & mbrs of Board of Education individually. |
