View Entry 1931 C.W. Frye v. Southeastern Express Company Shelby Breach of Contract

The plaintiff shipped one bird dog from Finger Tennessee to Fort Plain, New York. While the dog was in the possession of the defendant the dog was injured and by reason of such injury became worthless and thus breach its said contract.

Johnson sued defendant for debt due by breach of contract involving an exchange of automobiles in that it failed to comply with conditional sale statute of TN, to his damage under $500. Possibly related to Johnson City Buick Company v. Edgar Johnson located in box ET 742. 2 folders.

View Entry 1931 F. L. Barrier v. McFadden & Oates Shelby Contract Dispute and Damages

Case concerned a dispute on amount of commissions owed by defendant for cotton bought and sold by the plaintiff on the defendants behalf. Case file appears to not be complete. No docket number indicated. Folder 2 contains an envelope with 223 pages of receipts that were filed as an exhibit to the case. See WT2126 for another envelope of receipts (302 pgs), 2 stuck inside envelope.

View Entry 1931 G. D. Webster v. Bird Broyles Inc. & Sherwin Williams Paint Co. Washington Breach of Contract

Webster sued defendants for debt due by account for breach of contract to purchase stock in the sum of $300. Court ruled in Webster's favor for said sum. Sherwin-Williams sought certiorari, claiming they had no notice of pending suit or judgment.

View Entry 1931 John E. Iverson v. Automobile Sales & Service Company Washington Breach of Contract

Iverson traded in Graham-Paige sedan & bought DeSota car from Def., who then held car in trust for Iverson until he could finish paying for it, but while doing so, Def. sold it to someone else. Iverson claimed Def. violated conditional sales law. Witnesses: James Hendrix & A. B. Roark & A. D. Stansberry, Luther Morrell, C. A. Johnson (all worked for Def.)

View Entry 1931 M. S. Watson v. Crockett County Crockett Breach of Contract

Plaintiff sued for $16.00 he claimed the county owed him for handing out notices to Road hands. The notices were warnings given to the Road hands to perform their work duties on the local roads in Crockett County. The county claimed they did not owe the money, citing that Section 7 of Private Act 784 of the 65th General Assembly was unconstitutional.

View Entry 1931 McFadden & Oates, a partnership v. F. L. Barrier Shelby Contract Dispute and Damages

McFadden & Oates: George McFadden, W. L. Oates, and Edward Browning Jr. Barrier initially sued for $1925, the amount due on a contract between himself and the pltfs. Pltf.'s appeal only, see WT2075 for more files. McFadden & Oates were dealers in cotton. Housed in 2 folders.

View Entry 1931 N. A. Lackey& wife v. Carr Brothers Carter Breach of Contract

Original bill was filed when a breach of contract by N. A. Lackey occurred in 1927. The defendants bound themselves in a contract to furnish the plaintiffs' with $5,000 worth of building material and lumber and to use their best efforts to obtain a loan on their property if they didn't have the funds to pay the defendants when building was complete. The plaintiffs later failed to carry out their terms of the contract by paying 15% of the material not used, or $750.

View Entry 1931 S. L. Bauman v. Pickwick-Greyhound Lines, Inc. Shelby Breach of Contract

Bauman entered into a contract with Greyhound Lines to rent terminals for $1000 a month for 10 years; owed a total of $130,000 half of cover page is missing.
