McClary was elected road commissioner for the first district of Polk county in 1929 for term of 2 years. Alford claimed he was road commissioner by action of court in August 1930 in which plaintifff was removed and Alford was elected in his place. Plaintiff charged he never received notice of court proceeding. He was suing for possession of road machinery, which was unlawfully detained from him. Nicholson, justice of the peace, had issued a replevin on said machinery, which plaintiff declared void. |
