Pla. is the owner of white and red oak cross ties stacked at the tracks of the Louisville and Nashville Railroad at Harriman, Tennessee and purchased from Fort Bros. A bill was filed against said Fort Bros. by several of their creditors and the Def. Kellogg was appointed as receiver of their property. Pla. alleges that as receiver, the Def. unlawfully retained white and red oak cross ties legally purchased by the Pla. |

Pla.. sued to have the insurance policy of Dillard Barnett paid to her as she is his beneficiary. Barnett took out the policy with the deft. in 1922. In 1923 he left TN for VA. Pla.. & his relatives have not heard from him since & cannot locate him. Pla.. has continued to pay the premiums on the policy. Deft. maintains that it has not paid because pla.. has failed to provide proof of Barnett's death. It is suggested that Barnett may have been ill with tuberculosis when he left TN. |

Additional defendants: M.A. Duggins and L.A. Cross. Plaintiff had deposited $5000 into the Bank of Oliver Springs who executed a certificate of deposit, which was endorsed by the defendants who became liable to the plaintiff for the same. The Bank of Oliver Springs failed and was being liquidated. The reciever made payments on said certificate from time to time but $1500 remained due, which defendants had refused to pay, therefore the Peoples Bank sued. 2 folders. |
