Incomplete case. Briefs only. The Allison Lumber Co. furnished defendant with lumber under special contract for use in the building of a house on her property. All the lumber was contracted for and furnished prior to an execution of a deed of trust to W.A. Sadd and Taylor Durham, trustees, to secure a loan from the Chattanooga Savings Bank & Trust Co., except $134.56 worth. The plaintiff sought to hold def. to the contract made on her behalf by her husband as her agent. |

Mrs. North stored a mohair sofa & bundle of cushions at Rowe storage facility for four years. The contract said that Rowe would not be liable for damage to stored items, including moth damage. The sofa was sprayed regularly with moth deterring chemicals, but when it was removed from storage, the sofa was substantially damaged by moths. |

He maintains that a ditch the city built in tandem with new street construction is reducing his property's value & destroying the houses & out-buildings on it by collecting all of the water in the neighboring territory & discharging it onto his lot. Suing to recover the money (about $1000) that he has spent in trying to address the problem himself & asks the court to enjoin the city from allowing the drainage problem to continue. 2 Folders. |
