The complainant deposited funds into defendant bank which included two Alex McMillan Company bonds. The defendant without the consent of accepted a check instead of cash from Alex McMillan Company and waited until Monday to present. The check was refused because of a lawsuit and the insolvency of McMillian. Warwick was a cattle dealer who had a checking account with the Maynardville State Bank. He took checks from various people and deposited them in bank. One day, he gave a check to Archer for $456 in a Graves & Seymour Grocery Co. to take to the bank. When Warwick balanced his account, he was not credited with the amount either due to bank's oversight or Archer's withholding said deposit.
