Defendant claims that he came upon a box sitting out in the open near a construction site where the plaintiff was conducting grade work with explosives. The defendant opened said box and found blasting caps, which he then took. The next day the defendant was picking the caps over a hot stove when the caps exploded causing considerable injury.
