Shipley was an employee of the Standard Knitting Mills and was enrolled in the group life insurance program provided by said employer through the def. and to which the pla. was the beneficiary. Bessie became ill and died on Oct. 28, 1931 in Knoxville General Hospital. Pla. claims the def., in breach of contract, has refused to payout the said policy. Exhibit materials include correspondence and employment information. Bessie had a 7th grade education and made $0.21 per hour. |

Deft. argues that it owes Miller nothing as her insurance with it had terminated & was cancelled, she had failed to file due proof of her disability as required by the policy, & was not totally & permanently disabled. |

Plaintiff are partners doing business under the firm name of Twin City Junk Company. sued the def. for $1,900.00 for in 1931, the pla. were the owners of a truck on which they held an insurance policy with the defendant against accidents, including fires. The truck was destroyed by fire and its actual value at the time was the $1,900.00, which the policy should cover, but the defendants are refusing to pay. Suing for an additional 25% penalty provided by statute. |

Whitzel went to Chattanooga after being hired on probation as a canvasser. He came to like the city and wished to moved his family there from Kansas. He was then let go and sued. A complication arose after the jury announced its verdict in Whitzel's favor. Two jurymen, C. R. Buford and B. F. McGill, told the court that the decision had not been unanimous even though they were believed to have voted with the majority so they could go home. |

The Def. charges that the Pla. willfully burned the store himself and refused to honor the insurance policy. Plaintiff is noted to live 17 miles from Greeneville and 4 miles from Romeo on Gap Creek Road, or Horton Highway. The Plaintiff's building was the only one in the community, which was comprised mostly of farmers. |
