View Entry 1932 Boyd J. Shipley v. Metropolitan Life Insurance Co. Knox Insurance Disputes

Bessie M. Shipley was an employee of the Standard Knitting Mills and was enrolled in the group life insurance program provided by said employer through the def. and to which the pla. was the beneficiary. Bessie became ill and died on Oct. 28, 1931 in Knoxville General Hospital. Pla. claims the def., in breach of contract, has refused to payout the said policy. Exhibit materials include correspondence and employment information. Bessie had a 7th grade education and made $0.21 per hour.

View Entry 1932 Carrie Miller v. John Hancock Mutual Life Insurance Co. Carter Insurance Disputes

Plntff., an employee of the Bemberg & Glanstorff Plants, is sued on a group health policy for $1100, the amount of her certificate, plus a $275 penalty. The $1100 was to be paid if the policy holder became permanently disabled, which she has, but deft. refuses to pay. Deft. argues that it owes Miller nothing as her insurance with it had terminated & was cancelled, she had failed to file due proof of her disability as required by the policy, & was not totally & permanently disabled.

View Entry 1932 Glens-Falls Insurance Company v. Twin City Junk Company Sullivan Insurance Disputes

Add. Material in ET 1415. Plaintiff are partners doing business under the firm name of Twin City Junk Company. sued the def. for $1,900.00 for in 1931, the pla. were the owners of a truck on which they held an insurance policy with the defendant against accidents, including fires. The truck was destroyed by fire and its actual value at the time was the $1,900.00, which the policy should cover, but the defendants are refusing to pay. Suing for an additional 25% penalty provided by statute.

View Entry 1932 Hershel Burton v. Prudential Life Insurance Co. & Miller Brothers Co. Washington Insurance Disputes

Plntff. a former employee of Miller Bros. & holder of a group insurance policy that will pay $2000 should he become totally & permanently disabled due to illness. Plntff. avers that he is now disabled under the provisions set forth by the policy, but Prudential has refused to pay his claim, forcing him to seek legal recourse. Plntff. asking for $2000 plus 25% penalty for non-payment of his claim. Deft. argues that plntff. is not sufficiently disabled to meet the contract's criteria.

View Entry 1932 John Franklin v. Atlanta Life Insurance Company Hamilton Insurance Disputes

Defendant issued to Plaintiff a sick & accident insurance policy, No. 1447039. Less than 1 month later, Plaintiff fell sick (paralysis) & became disabled. Defendant initially paid Plaintiff under the policy, but then stopped paying him, a dispute having arisen over the correct amount payable under the policy.

Plaintiff had an insurance policy with the defendant for loss by fire up to $1,000.00. Fire later destroyed lumber on yard, in sheds, and a warehouse owned by the plaintiff. The defendant refused to pay the policy and the plaintiff is sued for $3,000.00 for principal and interest plus a 25% penalty for failure to pay within the statutory period.

Petition of N. P. Horton of Kingsport for damages in the sum of $3,600.00 plus interest caused by loss by fire March 11, 1930. Case file includes photographs showing damages to residence. Two folders.

View Entry 1932 Physicians Mutual Health & Accident Insurance Company of Nashville, Tenn. v. Dr. A. H. Grigsby Washington Insurance Disputes

This suit was instituted by Dr. A. H. Grigsby against this insurance co. to collect the sum of $500.00, which plaintiff alleged he was entitled to by reason of injuries, sickness suffered by him while carrying a sick & accident insurance policy with said insurance co. Dr. Grigsby suffered from eczema. His claim was that he suffered from occupational dermatitis caused by use of Novocain.
Case appealed to TN Supreme Court.

View Entry 1932 R. G. Dun & Company v. Frank R. Whitzel Hamilton Contract Dispute and Damages

Whitzel went to Chattanooga after being hired on probation as a canvasser. He came to like the city and wished to moved his family there from Kansas. He was then let go and sued. A complication arose after the jury announced its verdict in Whitzel's favor. Two jurymen, C. R. Buford and B. F. McGill, told the court that the decision had not been unanimous even though they were believed to have voted with the majority so they could go home.

View Entry 1932 R. L. Ward v. Merchants Mutual Fire Insurance Co. Greene Insurance Disputes

Pla. is a merchant located in Greene County. His store and merchandise, which were insured by the Def., were destroyed in a fire. The Def. charges that the Pla. willfully burned the store himself and refused to honor the insurance policy. Plaintiff is noted to live 17 miles from Greeneville and 4 miles from Romeo on Gap Creek Road, or Horton Highway. The Plaintiff's building was the only one in the community, which was comprised mostly of farmers.

Defendants: Burkett Miller, Vaughn Miller, and F. Linton Martin, all of Hamilton Co., TN surviving partners of firm Miller, Miller & Martin. Plaintiffs: John A. East, Walter L. Howard, and Thomas H. Phillips- residents of Roane Co. who constitute the Mayor, Board of Commissioners of City of Rockwood. Recovery against City a judgment of $4,000.00 and costs, dispute over taxation, 25 Sept. 1931. Court decision appealed to Supreme Court @ Knoxville.

Issue of the insurance policy on the life of Frank Mathews (dec'd) in which the plaintiff was the beneficiary and the policy provided for a death benefit of $225. The defendant states the premiums on the policy were overdue and refused to pay the policy.
