Other defendants: G. W. Kite & wife. Lipford sold tract of land to Kite. Dispute over mineral rights concerned Kite's sale of land to the state which intended to use the limestone rock for building highways. Kite felt wronged by the sale & filed an injunction hoping to stop further removal of rock. Lime was commonly used for agricultural purposes. Also mentioned: D. E. Slemp, Godfrey Stout, W. H. Additional Plaintiffs: Hubert Weddington & Eva Robinson, children of Alfred Weddington, dec. July 1895. Sallie Wallace his widow. Plaintiffs argue that def.., whose property adjoins theirs, trespassed, cut & sold valuable timber & caused other property damage. They ask court to establish their boundary line, enjoin Tolliver from trespassing & recover from him value of timber & other property damage. Tolliver argues that boundary line is in error & the property is actually his.
