Plntff. the beneficiary of a $1000 life insurance policy on the life of his father, Blount Morris, who died in April, 1876. Plntff. was suing to collect the $1000 plus interest because the deft. has refused to pay despite having received timely & satisfactory proof of his father's death. Deft. argues that B. Morris violated the policy's terms by misrepresenting his age & state of health. He claimed an age of 60 but was actually 69, an age the deft. does not insure, & had several ailments. |
