Collins sued Foshee and several other defendants for trespass and damages of $40,000 for taking and converting to their own use Collins' personal property, including: horses, mules, hogs, bushels of corn, wheat, hay, cattle, sheep, etc. Collins also suing for being maliciously forced out of his house, destroying his farm houses and other property while def'ts occupied them as camping grounds. Suit began in 1865. |

Jane C. Brackett divorced Adkins Brackett and was awarded one-half of his assets. Additionally he was made responsible for court costs. When he couldn't afford it, the sheriff levied the costs upon his land. Brackett argued that would make him destitute, therefore unable to pay alimony. When the sheriff auctioned the land at a courthouse sale, the high bidders were Owens, J. M. Clementson, W. L. Lane, W. S. Jaston, and E. L. Miller. Brackett (who later married Eliza Haney) asked the court to void sale. |

Brock says heirs (Def.. Mees & Fyffes) knew of sale yet have tried to claim land due to this error. |

Joseph Smith possessed an estate worth $745 after payment of debts. Margaret Peters suing for possession of land due her as widow. Pickens wants injunction against Ballow to keep him from prosecuting his action of ejectment. Plaintiffs charge that Ballow is entitled to only part of the land. |

The plaintiff claimed that by means of faulty construction and bad condition one of the mules got its leg through a hole in the end of the care and that when he went between the cars to mend it during a stop he got caught between the cars and killed. |

Case file is incomplete; brief only. S. P. Hale is the regular guardian of the 6 heirs and minor children of James A. Tucker, dec. James A. Tucker died intestate in July 1880, seized and possessed of a parcel of land containing about 480 acres lying in McMinn County. C.L. Tucker conveyed his interest in the land to Mont. Reynolds and asks the court to sell the land for partition and the funds deriving from the sale be divided among the entitled parties. See also ET box 1910. |

Elizabeth McClemon gave six or seven thousand dollars to her brother in law, Francis Pettit to purchase land in McMinn County. He purchased the land in his name only and allowed her to live and farm on part of it. Pettit died without a will and now Elizabeth is in a dispute with his heirs over her right to part of the land. |

The plaintiff entered into a contract with the Athens Table and Manufacturing Co. to insure her son, Oran Melton, an employee of said co. Oran became sick with typhoid fever and died in July of 1930. The defendant refused to honor said contract saying Oran terminated his employment with the Athens Table Manufacturing Co., voiding his insurance policy. Exhibit material includes the insurance policy contract. |

The plaintiffs state the defendant mismanaged the will and estate of the deceased in regards to a tract of land that was to remain in the plaintiff's possession for ten years and then be sold for the most beneficial price, but the defendant tried to sell the land before the time stated in the will. |

Subsequent to the patent letters, the plaintiff entered into a contract with the defendants after a lawsuit of infringement on the Oliver Chilled Plow Works. The plaintiff claims he is entitled to payment of damages by the Oliver Chilled low Works and that the defendant had no right to compromise all claims for infringement on the patent contracts and is demanding $2.50 of royalties per plow. |

John failed to file a deed of sale, & the heirs wished to clear up the ownership of this land. |

Phillips and Bridges had entered partnership for term of 5 years to purchase and sell carriages, buggies, harness, and trimmings. Bridges kept the books and papers of firm. Phillips charges the profits are more than the $1700 claimed in books. He also states firm was indebted for $5400. Phillips charges he has only received $6700 of $9750 capital due him--relying on Bridges, who had withdrawn all interest, to pay him his due. Phillips also seeks court to stop Bridges from selling his property. |
